The Municipal Court in Prague confirmed to Lukáš Nečesané compensation of damages of 1.7 million crowns and default interest for illegal prosecution and for two years in prison. It follows from the judicial database, Czech Television drew attention to the decision. The decision is final. Necesaný faced six years of prosecution for the attempted murder of a hairdresser in Hořice in Jičín. The damages exceed the amounts normally awarded for wrongful criminal prosecutions.
The district court for Prague 2, whose decision has now been upheld by the city court, stated when delivering its verdict in October that the prosecution interfered with Nečesané’s personal, family and work life. At the time, the judge pointed out that at the time the prosecution began, Nečesaný was a very young and unpunished high school student whose detention prevented him from graduating on time. She also pointed out that the final acquittal of the criminal court did not bring about the “desired cleansing of the plaintiff” – the chairman of the appeals panel, Jiří Lněnička, stated at the time that he did not consider the acquittal correct, but that he had no other procedural option.
Both the Ministry of Justice and Nečesaný appealed against the October judgment of the circuit court. Uncombed claimed 18.8 million crowns from the state. He can file an appeal to the Supreme Court against the current decision. The Ministry of Justice has already paid the man 1.2 million crowns in the past.
The attack on the hairdresser happened in February 2013. The perpetrator hit the woman on the head with a log and took over 10,000 crowns from her. The indictment blamed Nečesané, who lived in Hořice with his grandparents, for the crime. The attacked woman did not recognize him as the aggressor at first, but later identified him as the attacker. According to forensic experts, she suffered memory lapses after the attack. The Hradec Králové regional court repeatedly sent the young man behind bars, after the intervention of the Supreme Court and a change of the criminal panel, he was acquitted twice. The Prague High Court always annulled the acquittal decision and requested a new hearing. He only confirmed the acquittal in March 2019.
The uncombed grandparent, parents, wife and brother also wanted compensation from the ministry, they calculated the claims at a total of 25 million. After the office did not comply with them, they filed lawsuits, which they later withdrew. Nečesané’s parents themselves faced another criminal prosecution – the former director of the Liberec regional hospital Luděk Nečesaný and his wife Šárka were accused in a corruption case. But the courts acquitted them, Necesány the elder related the accusations to his fight for the purification of his son.
